roomate rental in a condo?
I own a condo. Do I have to notify my homeowners associaton if I am going to get a roomate? I got a letter in the mail saying that the association has a policy that if I want to rent out the condo, I have to submit an application to the association with a fee for a background check on the possible tenant. Does this only apply if I move elsewhere and rent it out? The person will get a mailbox key, a key to the pool/fitness center, and a pass card to the front gate.
Generally, if you are living in the unit, it is considered “owner occupied”, so you might not have to be treated like it’s a rental unit, but it depends on the wording of your declaration (CC&Rs) and your Rules & Regulations.
If an owner’s spouse, significant other, or family member lives in the unit with the owner, they are considered the same as the owner. A roommate might be different.
I would call your management company and ask them what the policy is for owners to have roommates.
